    I guess this more or less confirms what's been said here by various knowledgeable sources.

    Also reinforces my comments under "legal way to reinstate your discharged debt". Some companies - and this doesn't just apply to collection agencies, but across the business spectrum - just can't seem to be satisfied in making their living through the honest performance of their chosen field.

    They have to go after every last dollar they can possibly get their hands on, regardless of who they have to scr*w to get it. Crack-wh**e may be too strong an analogy, but it's not far off.

    Thanks, DB, for the San Francisco Chronicle article on the Providian/NCO issue. The NCO spokeswoman's refusal to comment may reflect some apprehension at the NCO front office over this. Depending on how many of these letters went out, how many complaints were filed, and how many lawsuits result, this could become a legal headache for NCO of equal or greater magnitude than last year's re-aging problem. And if other consumer reporters around the country pick this up, the bad publicity will just compound the problem. The publicity may also help others in this situation learn their rights.

    The comment about the spokewoman who couldn't make any comments about the issue, does not mean they are hiding or admitting to any wrong doing. Any NCO employee, no matter what their position is within NCO all sign "gag" order agreements upon hire stating that if they are approached by any media, we are not to respond or comment. Instead, we are told to direct the media to certain people for comments.

    I understand that the average employee at NCO is not allowed to speak to the media on behalf of the company. That's true at most companies. But usually there is a spokesperson or press officer who does speak for the company management. This woman seems to be a company executive by title and appeared to be presented as the company spokeswoman. That she refused to comment (or refer the reporter to a press office)seems telling. There was not even some bland PR-type reply. Also, I wouldn't expect an NCO spokesperson to admit any fault. The company never did admit fault in the FTC settlement last year either.     Is it a crime or against federal/state statute to try to collect on a discharged debt and if so what law and what are the penalties for doing so?

    Stew: Can't say for sure, but it is considered contempt of bankruptcy court, so that would be a state issue. Probably also something in FCRA or FDCPA.

    LOL! I wonder if they saw this site...all of us pestering you on your blog about whether or not you'd heard anything about an issue with Chase! I'm speculating that an even larger settlement the one than back in 2004 is on the horizon. Ejack - you've earned a word or two. He really has Basher - he's kept quiet all this time.

    MadEye: Settlement has a good chance of being larger I'd say. Just wish we who were affected could get a piece of it - more than 10 cents anyway.

    I think now they WILL start a department to verify status of accounts they buy. Or at least assign someone in the call center in Bangladesh to check them out.

    If they had done this, they obviously would have found my current address which hasn't changed for 6 years and not sent it to my mother in Vermont where I've never lived.

    I think DebtorBasher needs a promotion to the head office. They need someone who has a concern for details.

    DhBruns...if they had your address in Vermont...then NCO isn't allowed by Vermont state law to even pull your credit report to view.

    DebtorBasher: They had my mother's address. I've never lived in Vermont. I guess whatever skip tracer was looking for me got the forwarding address she had filed when my parents moved up there from our old family address. But even that was at least 3 years ago.

    Corporate sleazebags embezelling 600 million dollars... What the f**k do you need 600 million dollars for?? Oh yeah, so you can have more than the guy with 500 million... Sorry wandered off into WorldCom/Enron territory there.
