Misrepresentation by sales person/Charged for products not ordered - CigArrest gum, vitamins, tablets

Location: Carlsbad, CA

Salesman called on phone after I'd gone on internet on a quit smoking site. He offered a $1.00 trial order, cancel at anytime.
After I received first packaged called and cancelled any future orders. Received second shipment, then noticed I'd been charged over $200 on bank statements! I had been out of state due to family emergency.

Have sent numerous emails since Feb 14, 2007 with NO RESPONSE.

When I call their 800# for Customer Service, learned it's merely an answering service. You can find no information on this company or where they are located or owners. Did receive a P O Box in Carlsbad CA yesterday from person at 800#. He sounded unaware of any complaints which is difficult to believe. If you google cigarrest on internet you will find numerous stories similar to mine.
How can a company get away with this rip off!????

I am a grandmother, living with my son and grandson, and have no income. These charges were on my son's account and have caused me much grief and stress for feeling duped and used in this way. I too (as others have stated) can not afford an attorney. I also could not afford $200 charged to our account.

    CigArrest is one a of a number of businesses operated by Bernheim & Rice Inc, 170 Eucalyptus Ave, Vista CA 92084. Phone number is: 760-631-3535. Fax number is: 760-631-8060.

    They've been pulling this scam for years. From what I have read even though you think you have canceled they tend to hit your card a few more times for shipments never received. a few people have reported success with a refund but only after being extremely persistent. Also a few had to cancel their cards to stop the charges.

    BTW: Bernheim & Rice is listed as a law firm by the Vista Village Business Association.

    The bank can't help with whats gone, but they can put a stop to any future withdrawls. Call the District Attorneys office in the ripoff companies county and they will take care of it or give you direction.

    I called the number for Bernham et al. and they had a choice that took me directly to a real person at Cigarrest (supposedly the same number as the Cigarrest customer service number to get a return authorization). I was able to get a RA number to return the materials and get the money back for items received less than 60 days ago. __ We'll see if I get my money refunded to credit card used. I'll let you know. -- at least I got to talk with someone this time.
