SOUTHERN, MASSACHUSETTS -- Hi upon eating a brownie i bit on something hard. I broke a front tooth off at the gum line. Upon inspecting the food matter i was chewing, there was a one half inch walnut shell that caused my tooth to break. After numerous letters,e mails phone calls etc, the company will not return my correspondence nor will they pay for any dental work to fix my broken tooth. They are now duncan hines, owned by pinnacle foods and will be sold again shortly. I must say the company cshas no valid reason dor not paying my claim. I even sent them a piece of the shell so they could "verify" that it came from their product..I beleive their policy is to deny all claims. This tooth will cost about 5200 dollars when completed. I am not asking for any pain and suffering damages just to replace my front tooth. I have spent over 1000 dollars already as you all probably know, dentist get paid at the time of service, i can not afford to have the inplant done . Small claims here in massachusetts has a max of 2500. I am sooo frustrated i just had to vent. I honestly beleive they want to litigate this. Why should i give a lawyer 1/3 on such a small case. I am just amazed. Pinnacle foods owns duncan hines, most proctor and gamble productsw, vlasic pickles etc.They are one huge corp. I cant even get a return call, e mail etc. Its like they are king of the world , we said no and we will not speak to you again. Would love suggestions. I will post this for the rest of my life if i have to. So unfair. We are a fascist country where corp run the country or heading that way. I thought this would be a simple claim. Maxine weber if you read this i hope you break all your teeth on the next product you eat!!!!

You should have not sent them the evidence which was a piece of walnut shell since they will the deny any wrongdoing. Instead, the evidence should have been sent to the health department or to a 3rd party laboratory for testing.

You should have immediately of hired a lawyer. Your lawyer is the one who should of contracted them.

Sorry to hear about the broken tooth...but I really don't think you would win a case against them because their defense will be that if it was a walnut brownie, then the walnut shell is not considered a foreign object. I think that really stinks because we don't buy walnut brownies, expecting to break off a tooth with the shell...but I've seen in on one of those TV court shows when someone was sueing over something similar and the judge said if it's part of the food that is included in the product then it isn't considered a foreign matter and they did not win their case. It's like finding an eggshell in your Egg McMuffin. But...I'd go for it anyway because that was just one judge's opinion...I would not have sent it to the company, if anything I'd send them a picture....good luck to you and keep us updated. Again, having your tooth break off like that is horrible.

I must agree with all the above and I hope you at least get your tooth fixed, I know that must hurt. OUCH!!!
