Bounced ACH deposit considered check fraud?? - Check fraud?

I wish I had found this site before my first contact with NCO Financial. They called me at work and wanting to get them off the phone quickly I agreed to a payment schedule on a Capital One account they were trying to collect upon. The first couple of bi-monthly ACH payments went through okay but the third one bounced due to insufficient funds.

Then I get a call from some guy telling me he's with the check fraud division of NCO. Of course this caught me off guard and I stammered out my apologies. Since when is a bounced check considered check fraud? Anyway I asked him to decrease I just couldn't make that big of a payment. I'll be the first to admit that my credit is tanked at the moment and I have every intention of paying off my accounts, but I can't get them all paid off at the same time. There's way too much month at the end of my paycheck.

Some of the "reviews/complaints" I have read here make me very uneasy in what I may be up against with these people.

    When you bounce a check it's check fraud. You gave them authorization to take funds out, promising they'd be there. It wasn't there. That's a fraud.

    Why did you agree to a payment plan you couldn't abide by? Just to get them off the phone? That wasn't smart.

    try to google www.budhibbs.com for help. you should have hung up,by the time they got your account they have tried or ruined your credit anyway so why pay the retards?

    You ask why, Brenda? I'd imagine it has something to do with the reason he's being hounded by collection agencies...

    geather-c maybe he/she wants to pay because it's the right thing to do and he/she owes the money? I think it's great that the OP is being responsible and wants to pay for what they owe.

    killer, he/she knows how much is made every month and what they can afford to pay. If you agree to pay and don't things just get worse. It's common sense.

    Paisley13, we all get into these situations at one time or another in our life it's not the end of the world. Don't let them beat you down. You can have them stop calling you at work and you can figure what you can pay and then put it in writing and have them sign off (or not) but just do the best you can to get them paid off and try to stay away from credit, its a rip off in it self. The www.budhibbs.com thing is a good place to start to find out what they can and can't do. But like Brenda says being responsible is the best way to get it over with. Don't let them run you though. Best to you and hope you get this behind you ASAP

    First of all...Bud Hibbs is only lining his own pockets and you will still owe your bills.
    NCO has a "fraud Department" but I have never heard of a "Check Fraud Department" and if you called and asked for that dept. I am sure they wouldn't know what the heck you were talking about...in that case it would be a "Mis Representation" violation of the FDCPA. Mis -representing themself to use as a scare tatic to pressure you into paying your bill. It is not NCO's fault that the funds were not available when you said they would be.     He probably told you he was with the Check Fraud Division to do exactly what he did, scare you. The others are right, if you right a check and the money isn't available to cover it, it's considered fraud. NSF Checks over a certain amount (varies by state) are considered felony offenses. Your best bet is to follow Lidman's advice and work out an amount that you can afford to pay and then stick to it. Good for you for taking accountability and trying to clear up your debts!

    Yes, as everyone has said, writing a NSF check is considered fraud. I am a collector, and I will defend the OP some. He mentioned that he agreed to 3 payments. Yes, he should not approximately what money he should have available through budgeting. But if this was a 3 month payment plan, it would be difficult to forsee stuff that could come up.

    In the end, I agree with Lidman. You have already paid part of the bill. Contact them and work something out for the rest of the bill and get rid of it.
