Discover Card Made My Life Hell - Credit Card

Years ago my sister had a Discover credit card. When I turned 18 she put me on the account to help build up my credit. (And just as a side note, I never used the card.) She suffered a physical & mental break down a few years later and had to stop working. She filed for bankruptcy and the Discover card was included.

(This was done before the laws on bankruptcy had changed btw.)

Now maybe what happened next was lawful...but it doesn't mean it was right.

I started to get hounding phone calls and letters from Discover card. I received phone calls as early as 6am and as late as midnight! And I was *lucky* if it was only 4 calls a day. I was contacted by collection agencies and denied car loans despite having, and I quote, "excellent credit if it wasn't for that $10K Discover Card write-off". It didn't matter who I talked to at Discover or how much I talked to them. I was even told that at the time of my sister's bankruptcy they simply took her name off the account and made me sole owner. I talked to CSR's, supervisors and even their legal department. Some people said simply "too bad" but most agreed that this account should not be held against me since it was included in her bankruptcy.

Even their legal department researched this and said that what they did was wrong, promising to take it off my credit and stop harassing me for money (this was told to me after 4 years of fighting). But nothing was actually done and was told "we have no record of that conversation".

At the end of 2007 it finally came off my credit but I still have received letters from collection agencies. Discover card has made my life hell.

    When she added you to her card, you also became responsible for any amounts owed even if you never used it. That's what happens in a joint account. When she added you, you assumed that any and all amounts owed were also your responsibility. They saw your sister filed for bankruptcy, so the next logical step was to see who else was listed on the card and go after them. I would be more upset with your sister as it sounds like she used you as a scape goat.

    The same happens when you co-signs a loan. If the originial person cannot pay then the loan company goes after you. And, in this case, it sounds like Discover Card let your sister file her bankruptcy but you were co-owner of the card so they are coming after you. By being on the card you are 100% responsible for all charges. I would highly suggest you get an attorney.

    Did you sign anything when you became an "authorized user"? If so, read it carefully. How was it worded? Likely, if you never used the card then they cannot imply consent to be responsible. If, in fact, you were only an "authorized user" it was not going to help your credit anyway.

    In any case, if this is over 7 years old DO NOT acknowledge anything to the collection agencies. This is no longer a legally collectible debt.

    Thank you tnchuck100. I was infact just an "authorized user" (which I should have mentioned in my post). I did have my sister's banruptcy lawer look into this, FoggyOne, who was able to obtain the form that was filled out saying I was just an "authorized user". This was presented to Discover which was one of the reasons why their legal department said I was not responsible for this balance. My post was really just to serve as a warning to anyone who might find themselves in a similar situation...and to vent about 7 years of hell.

    An authorized user, authorizes you to use the card but you are not legally responsiblity to pay. They can ask you to, but you are not obligated. Also, if you are authorized, it will show up on your credit report.

    My mistake, I didn't realize you were only an authorized user. I stand corrected. Thanks for all the clarifications, Foggy, TnChuck, and DB. I digress and am on my way back to insurance issues.

    Wait, so you were an "authorized buyer" (what they call it) but you got the account to help your credit? That doesn't make sense first of all. Second, that does sound like a tough situation though. The problem is that if you were in a situation where you would have the opportunity to build credit, you would have to have responsibility involved. So obviously they would hold you accountable if anything were to happen in order for you to build credit. So I don't know how everything was set up, but this sounds pretty standard to me. How they handled it though was a bit shaky. It was probably such a unique situation.

    If you were a authorized buyer it wouldnt help your Fico score anyway. If you were joint than that is what it is a joint account...even if it was not your charges you are responsible. If you are a authorized buyer you can take your name off a account at any point. I dont think that is what you were though...it wouldnt of been that tuff.

    I work there myself like fvertk and aquasue and you must of been a joint member not an authorized buyer. But I do agree thought with fvertk on how they handled the situation is a bit shaky.

    Unfortunately, you don't have too much to stand on unless you were included in the bankruptcy. What I can tell you is that I understand how unreasonable Discover is and they do use terroristic threats and predatory activity to intentionally cause harm to consumers.

    In my case, I never even had a card with Discover and got a bill in 1998 to my home addressed to "Jane Doe". Never heard anything else. I ignored it, but then in 2002 it popped up as a charge off damaging my credit. Called, filed disputes - they apologized and said they would fix my credit.
