Ok. We all know just how bad NCO is. Now it's worse >_<

I received a call today at 7:30am. I pick up the phone, say, "Good morning" and get, "Hello, I'm calling about a bill that you are delinquent on. We need you to make a payment today."

I mean, no: Hello/Is this so and so/I'm with so and so.

Blunt.

I ask them who this is, who the bill is for, all that stuff. Takes me almost *10 minutes* before I can get the 'phone drone' to give me any information at all.

The bill is for my late Mother. She passed away in 1999. Nine years ago.

I ask them why are they calling me and not my Dad and the 'phone drone' gos into, "Are you going to pay this or do we send this to our lawyers and notify the credit bureaus?"

WTF, I mean, WTF!

I ask for a supervisor and get "Are you refusing to pay your debt?"

"MY" DEBT?!?!

I hung up. It was either that or call this idiot some words my Momma told me ladies shouldn't even know.

Any advice here?

    First let me express my condolences for your mother's passing. What I would do is send them a letter, certified/return receipt demanding proof of this debt and what company this debt is for. When you find out that information I would contact the company that originally put the debt into collections and tell them that your mother has passed, send them a letter also certified/return receipt and enclose a certified copy of your mother's death certificate. If the debt is in fact valid, explain that your mother has passed away and that you did not know of the debt.     Thanks Prin. I still don't know 'why' they are contacting me about this. My Dad is still alive. I'm going to be calling him later about this to see if he has gotten any calls from NCO.

    I'll type up the letters today (one for my Dad, too, just in case.)

    No problem. We went through the same thing when my grandpa died. We had to fax his death certificate to discover card four times because they just did not get that he was gone. One person even told us that the certificate was a fake! Mind you this was six months after we just lost both of our grandparents, and my mom lost her parents. They died within three days of eachother and some yahoo was telling us that the certificate was a fake!

    If she passed away in 1999 this debt is no longer legally collectible.

    Once an estate is closed no one can file a claim for anything.

    tnchuck - Not legally collectible? Why? (Happy if this is the case ^_^

    PB - I hope that's the case, too ^_^ My Dad is living off SS and Vet Pen (and what I can sneak into his account without him knowing ^_~). He just wouldn't have the money for any large bill right now (don't even know how much it is >_<)and I would pay for it anyway.

    Mrs. V: Statute of limitations is 7 years on most debts.

    99.9% of the time when I see postings about collection agencies, I reply: 'Pay your debts.' In the .1% when the poster is completely innocent (as in this case), I go ballistic and say *&^%#!! Mrs. V, you've received some good advice from experienced members here. My *biggest* complaint about how to get these leeches off your back is the fact that it costs time/money to get rid of them. I'm a strong advocate of not getting government involved in our lives, but in these cases I think it should step in to put a stop to these harassing calls.     Some info you, Mrs. V, straight from the text of the law:

    Section 805
    CEASING COMMUNICATION. If a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further communication with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt, except --

    (1) to advise the consumer that the debt collector's further efforts are being terminated;

    (2) to notify the consumer that the debt collector or creditor may invoke specified remedies which are ordinarily invoked by such debt collector or creditor; or... more >>

    also, this website has information on the time limits. As you are as of yet unsure what the debt is actually for, i cannot tell you wich time limit applys to this situation. It seems most of them are 6 years...

    Arrrghh. They have called me no less than 9 times so far >_<

    On the 1st call I asked what was going on. Seems my Dad has aready told them (and I did talk to him a few hours ago and this is right) that the dept had ALREADY been paid. In 2000 (Mom passed Nov 1999 - bill was paid Jan 2000).

    He told them to stop calling them. So they got my number (I have NO idea how!) and are saying that sence my Dad wont pay it's MY duty to. On a bill that was ALREADY paid.

    I told them to not call me any more and that I was sending a letter to that afect.

    He told me that until they GET the letter they were allowed to contenue calling.

    Mrs. V: Send them a cease communication letter. Advise them this is not your debt. Include a copy of the paid account. Advise them that further contact will result in legal action against them for FDCPA violations. Send this letter certified mail/return receipt requested.

    ponie: While our law may be based on British Common Law our courts are only interested in what our United States laws actually are.
