MIAMI, FLORIDA -- We booked a NON-smoking, wheelchair accessible room on the NCL Jewel December 21 to 26, 2008 out of Miami to the Caribbean.

They put us in a room that stank of cigarette smoke and then refused to move us to a non-smoking room. We complained at the Front Desk on the ship almost every day of the cruise. They gave us at least three different stories over the week so we assumed that they were lying to us.

After they claimed that 'all rooms are smoking optional', they showed us a NON-wheelchair room that was also a NON-smoking room. If they have non-smoking, rooms for able-bodied cruisers, why don't they have non-smoking rooms for wheelchair users? Are they violating federal disability rights laws? Or do they just like lying to passengers?

After I returned home, I sent a formal letter of complaint to NCL, but they have not responded to the letter; it has been over three weeks.

I was sick most of the week so I really did not enjoy the cruise. We spent $1,300 on the cruise, another $1,600 on the airfare, and another $1,000 in hotels, meals, and related travel expense.

Every non-smoker and every wheelchair user should boycott NCL.

I think it is a violation of the Americans with Disabilities Act to not be able to provide a non-smoking wheelchair accessible room.

I believe there are circumstances that a foreign flagged vessel does not have to operate under American laws.

The ADA only applies to things in the USA. Almost all cruise ships are registered in other countries. In fact, I think NCL is the only cruise line with ships flying the US flag, but those are all in Hawaii.

We just booked on RCI and their policies now are no smoking in any cabin and only on ocean view balconies.

It is my understanding that NCL had to be legally forced to comply with the Americans With Disabilities Act--they would not do so voluntarily. They would not of their own accord make travel for their disabled passengers more comfortable because it would have cost them money--kindly consider that fact as an example of their apathy and lack of respect.
