Fry's Electronics Complaint - Toshiba 1735 Windows ME disk

WILSONVILLE, OREGON -- I bought a Toshiba 1735 laptop computer about a week ago. It was in a mislabeled box, and was open when the salesman brought it up to me. I expressed concern that it might not have everything in it, and he assured me that it did. I noticed that it didn't have the OEM windows ME disk in it, and he said it was on the restore disk. I tried to restore my files on to this computer, and found that it didn't have a restore capability. After 16 hrs of trying everything I could think of, I found out that I could get restore from the windows ME disk. I went back to the store to get it, and the computer department, service dept, and customer service all refused to give me the disk. Meanwhile, I have important files backed up from a previous computer I no longer have, and no way to get them. I was told that I could get it online, but I am wondering why you sell a computer preloaded with an OS, but no way to restore it if it crashes without erasing the whole drive. Also, your service department spend over 45 minutes with the computer insisting that MSBackup was there, only to finally admit that I was right - there is no way to get it without the OEM disk.
To help keep me as a potential future customer, I would like the following:
I would very much like to get the Windows ME disk
At the very least I would like a response from your company regarding this incident.
