NCO can't get their information right

So my student loan defaulted because a representative at Sallie Mae failed to enter the information I faxed her into the system to put me on an economic hardship deferment and then an in-school deferment. Needless to say I wasn't very happy. I contacted NCO to set up payment arragements, they refused because I do not have a checking account.

They sent me information on possibly garnishing my wages. I checked the box that said telephonic hearing because if they garnish my wages it will put me in a hardship again. I have since been in contact with NCO financial, they have my new address and my new phone number, well they have been sending mail to my old address still and they called my old phone number. Why can't one person communicate with another person when you update your information? So I received a letter stating that because I failed to answer my phone they are garnishign my wages 15%. I did not fail to answer my phone, they failed to call the correct number that they have in their systems. Now that they are taking that much out of my paychecks, we cannot buy groceries for our children or pay rent, all because they can't get their information correct.

    Something is not adding up here. NCO should not be able to garnish your wages with a court ordered judgment. They should not be able to get a judgment without a hearing. Did you, by some chance, ignore a notice of such a hearing. It would have come from the court, not NCO.

    If you did not receive notice you need to check with the court of jurisdiction at your previous address and see if a hearing was ever scheduled.

    You have a problem here that may take some doing to straighten out. Others will probably chime in here with additional advice.

    The OP probably had a judgment from NCO due to ignoring the summons. Which does sometimes come in the mail. You are not always served by a sheriff.

    hell sometimes they don't even use a sheriff or the USPS

    back when I was in Virginia my neighbor's abandoned their apartment. The court summons was posted on their doorpost... actually they stuck it to MY doorpost which freaked me out until I realized they screwed up and it was for the neighbor and not for me.


    Not sure what happened with that. I left the country the following day (deployment). Only thing I know is that when I came back there was an abandoned crappy computer hutch left on the lawn in front of my sliding glass door. So I took it...

    When finances are on the line like this, you need to confirm every conversation and fax with written letters, sent certified return receipt to show proof of receipt. The letters do not have to be detailed, just "this confirms our conversation today that my new address is xxx and my new telephone number is xxx. Use this address and telephone number in the future. DO NOT SEND DOCUMENTS TO ANY OTHER ADDRESS, INCLUDING ANY PRIOR ADDRESSES YOU MAY HAVE."
