My Father passed away over 10 yrs ago. ALL of his debts were sent through probate and done away with. My Mother is now 90 yrs old and NCO has been trying to collect on a credit card my Father had 13 yrs. ago that went through probate. They have harassed her for the last 6 yrs about paying this card balance.

We moved her to a nursing home 2 yrs ago and now they are sending collection letters to my address threatening to sue her. I hope they try it will be laughed out of court by our local judges who have a history of not tolerating such nonsense. And to the employee of NCO that posted how sad we are and should pay our debts I say...how sad that you cannot pay your research dept to actually find out if the people you threaten even owe you money. You are the scum of the earth and and ill trained in your job. Most of you knowingly break the law everyday at your job and are nothing more than criminals and the rest simply do not even know the proper way to collect a debt(I have worked in collections) and are ignorant of the laws in your field that tell you what you can and cannot say to debtors. I will be sending a dispute letter on her behalf as power of attorney and copies to my attorney generals office. I hope they shut you down!!!

    Have you never taken the time to notify NCO of the bankruptcy case # and discharge date? NCO gets debts as a third party. They don't know you or your parents. How do they know unless you tell them and they can verify it?

    Stop being a ninny and give them the info.

    When you father died, the debt either was or was not terminated in probation. That depends upon how the debt was structured. If your mother was also responsible for that debt because she was on it, NCO have a right continue trying to collect from her. She would still owe that debt if it was not paid off, although at this point, the statute of limitations may prevent any lawsuit to collect it.

    If she was not liable, then as LadyScot said, seems like you two have wasted a lot of time and energy for nothing instead of simply providing that information to NCO. Even now, why does it bother you. You are not responsible. Read and toss. Unless i... more >>

    NCO collectors are so much fun to toy with. I wish they were calling me. Here's what you do. The next time an NCO collector calls ask them if they've been washed in the blood of the lamb? Do your best to save their soul. Go all Pat Robertson on them. Start praying for their salvation then break out in tongues, ya know just spout out some gibberish... ralgrub drut em etib. Just remember the only power the collector has is the power you give them to upset you. Don't give it to them. That alone drives them nuts. Good luck.

    Its been years of this nonsense they have the info mam its been given to them several times. If they are calling I would guess they DO know who they are calling!My Mothers name was never on the card or the account and it was done away with. They even rec. a letter from our attorney showing this. So I am going to send the dispute letter again just like I did 3 yrs ago and do whatever else I can to put a stop to illegal collections by this company!

    Send them a cease all contact with you letter with the exception of a notice of their intent to sue. Send it certified mail/return receipt requested. Familiarize yourself with Fair Debt Collection Practices Act (FDCPA)

    Wait for them to call again and sue 'em. $1000 per violation.

    Wait I just read this again. It was not a bankruptcy was it? You said the debts went through probate...WHY was this debt NOT paid? In my understanding of probate, any debts by the deceased are paid FIRST before any transfer of inheritance is passed to a surviving spouse or children. Debts do not just get tossed into the void to be forgotten.

    You may better read the executor order again, or contact your lawyer to find out WHY your father's debts were not paid. Your mother as the surviving spouse SHOULD have been the executor of the estate and the responsible party for the paying of the debts.
