Americredit Complaint - They are finaly suing me !!!! bring it on i ready to fight! - truck loan

Back in October 2007 after my bankruptcy was dismissed, I needed a a vehichal to drive these crooks are the ones that would finance me. I missed a payment in August of 2008 they called blah blah you know the story well this is where the same ol story changes, they called my work I just happened toanswer the call, we have a policy not to take personal calls, well I told them not to call me here it is my work number. they had my home number my address and all the other ways to get a hold of me, well a week later they called again and my boss answered, well this lead to me being laid off he didn't want to fire me, so now I lost my job I was already a month behind on payment, since then I don't work there and haven't since beginning of 2009, theyhave called that place more than 2 times a day since my old employer had to block them they called so much. so I getting a lawyer and going to court, they cost me a job, my credit, and I am going to try to make them pay cause they violated fair collection acts by contacting a third party more than once to obtain information about me, and there more that they have done too, and they are suing me for the max on everything (legal intrest rate they can charge, attorneys fees, and then 8% intrest if they get the judgment agaist me). I also let them come get the truck and they actioned it for only $6000 when it was orth more. so wish me luck

I agree with just jamie. Once you missed a payment you placed yourself in this situation.

If you review your loan documents it is VERY likely that you agreed to allow them to contact you at your place of employment. That notwithstanding, your reference to the FDCPA and "telling" them not to call please know in order for that request to be valid under the FDCPA you have to mail them a written request as well. If you did not do so, they will offer this as an affirmative defense.

As for the amount the truck was auctioned for it is always less than the blue book value. They are now trying to seek a "deficiency" judgement against you and add on legal fees.

understand this, as i said they have done more than just what i have mentioned. i am not going to spell out my whole defense or what i have planned for them.
