NCO Financial Systems Complaint - NCO stikes again - My name and someone elses SSN

Complaint
Review by Mrs. V on 2011-02-04
***UPDATE***

I recieved a call today from a Ms. Stattler. She called to appologize for the inconvence and to let me know that the Drs. office manager had called her to inform her of the error. She left me her phone number incase I had any other problems with NCO calling.

*********************************************************************

I have been getting calls from NCO again. This time, for some unknown reason, they have my name but someone elses SSN. The account isn't mine. It's for a Dr. that is in SoCal. I've never even been to CA. I have tried explaining this to the people that called. I sent the letters asking for validation/verification (return recept requested, of course). The letter I received back just states that I owe this and the name of the Dr. and address along with the date of service.

Now they are demanding *my* SSN. That is something that I will NOT give them.

They have now started threatening to report this to the credit agencys if I don't cooperate and give them my SSN.

If they don't have your SSN, they can''t report you. If something were to show up, all you'd need to do is dispute is as not your tax ID.

That's crazy that they're asking for your SS#! Scary world we live in.

Mrs V, years ago I had something similar happen only it was apparently a Citi bank account - I'd never done business with Citi and I couldn't get NCO off my back so I called Citi directly and ended up working with their fraud department to get NCO to stop harassing me.
Can you contact this doctor's office yourself and see if they can help you straighten it out? Do NOT give them your SSN either tho.
Even if NCO did figure out how to report this to the credit agencies without your SSN you would be able to file a dispute and it wouldn't show up anyway.
Don't let those jerks bully you around - Fight Back! :-)

Maybe Basher can help you out she used to work for them.

they can't report you if they don't have your ss# :). Thing one, don't give it to them. Thing two, I believe you have to send them a cease and decist letter to get them to stop bothering you. If they don't, you can sue them. Can someone correct me if I'm wrong, please?

Thanks all. I did send the letters and they are still bugging me >_< Stating that they never received them even though I told them that I have the return recipts.

Just, I did as you suggested and called that Drs. office. The office manager (a very nice lady) said that they do have a bill for someone with my name BUT not with the same middle name nor SSN. I asked them to PLEASE call NCO and tell them to stop bothering me. She said that she would on Monday. Hope it works!

Obtain a copy of your credit profile from all three reporting agencies. It is highly likely they have already made an entry. Dispute the entry with the credit reporting agency.

Send NCO a letter telling them to "cease and desist" contacting you for a debt that is not yours. If they continue to contact you after receipt keep a log of all telephone contact and keep any letters they send you. Once you have established a pattern of them contacting you file a lawsuit in small claims court.

Mrs V, send the letter via certified mail with delivery confirmation. That way, when they bug you again, you have proof that they have indeed been notified.

I did send the letters. Return Reciet Requested and Certified. They just claim that they didn't get them and don't listen to me when I say that I can prove that they did :(

Now I'm just writing down when they call and I'll file a small claims when it's over ^_^

Mrs. V, small claims court cannot help you with this. It must be done in federal court.

This may help:
Fair Debt Collection Practices Act (FDCPA)

As others have said, without your SS#, they can't report it to YOUR credit report. Whatever you do DO NOT give them your SS#. Since you sent them the Cease and Desist letter certified with return reciept and have proof they contacted you since they got the letter, that is all you need to file a lawsuit against them. The collector wouldn't know if the letter was ever recieved or not because the collectors doesn't get the mail. The company should have removed your phone number/address from the account and documented the account that your info was the wrong person and it should have been removed from the dialer until they were able to find the right person.

DB is correct, as usual. If you sent it the right way and have proof that they did receive it, then it's time to get your lawsuit on :)

nco is bottom feeders. they do what ever they want regardless of the law. i had a friend who sent them the cease and desist letter, and one week after the green confirmation signature card arrived back, they started calling again.

there are lawyers on the net that handle cases against nco. try looking for one that will take the case, sometimes for free.

Thanks all ^_^ I'm hoping that the Drs. office calls them Monday to tell them to knock it off. I explained the the office manager that while NCO is bugging me, the wrong person, they will not ever get the money due them.

Thanks Chuck, I'll looking into the Federal filing ^_^

And thanks, Basher, I wasn't thinking about the person calling me not being able to know that they received my letters without someone putting it in the comp.

Mrs. V... I forgot to mention in my comment yesterday, but you should also ask the Dr office to not just call them, but to send them a letter of notification that the debt is not yours..and send you a copy of that letter as well. When I dealt with NCO over the citibank issue, I never had to resort to certified letters or lawsuits, once they heard from Citi that they had the wrong person, that was the end of it. Hope you have the same outcome!
