You seem to be one of the more knowledgeable/level headed people I've read. I'm interested in your advice, if you would give it.
My story is...I got into debt with an American Express corporate card. About $10,000 worth. I never tried to get out of it, just get myself in a position to pay it back in a responsible manner, so as my other obligations (child support, etc)were answered for also. AMEX turned my offer to repay them down because the amount I offered was too little (actually their representative said yes, but they called back and said he shouldn't have told me "yes", and the deal was revoked. I would first send a letter registered mail (RM) to NCO demanding proof that they own the debt, when they bought it, and from whom. I would do send another letter (RM) to AMEX demanding proof that they sold it and you're no longer in their system. I would put on both letters, which you should have notarized, that until proof that they own the debt is given in writing, no communication other than the written validation of ownership (This is NOT validation of the debt) is to take place between you and them. Include in the letter that you are eager to settle the account and get on with your life (gag…cough - we'll see though…wink win more >>

Madeye, Thanks for your answers. To answer a couple of questions for you...
The NCO rep told me that AMEX is her "client", and that AMEX has NOT sold the debt.
I live in California.
There has been NO written communication between NCO and me.
By the way, she called me and said the check was sent to New York (she said it crossed state lines which is a felony), but her area code comes up as a 760.(which according to a phone book, is in California) Is there anything to this or should I ignore it?

Firstly - Since AMEX still owns the debt, ask her how much AMEX authorized NCO to settle for. They won't tell you but tell them you'd rather go back to the original creditor and pay the full amount than to give her anything.
If she says that you should pay her instead because you'd be paying less, tell her you'd rather sue her for violations of the FDCPA. Threatening legal action - implying that you committed a crime. Tell her the phone log can be demanded with an order of discovery, and your phone records show the phone call being made…Secondly. You committed no crime. We don't have debtors' prison here in America…in any state more >>

Wow, that's a load off. I don't really have a way
to record the phone conversations, as they have taken place on my Boss' telephone. I have told them not to use this number already, however she started calling me here Tuesday 6/8/04.
As there's not really a way I can record the phone conversation, and NCO hasn't sent me any correspondance, any evidence I have, would be my word against theirs. Again, thanks for your time.

You're welcome. If they're calling you at work, you can send them a Ceased and desist communications at place of employment letter citing that your boss doesn't allow personal calls. They're supposed to take your work number out of the system when you tell them this the first time, but it doesn't always happen. If they call you again after you send that, they're in obvious violation of the FDCPA. You'll do fine. Let me know how your conversation with AMEX goes.

I posted Unauthorized debit on 6/13/04. The feedback that I received led me to believe that I have a case against NCO. Realizing that you are one of the most knowledgeable of Fair Debt Collection Practice Act and how collections agencies can be sued for their violations I decided to write you directly asking for your advice. I feel my lawyer friend has taken minimal initiative to get the problem solved. Is there a lawyer or legal advice that you can give me?? I need a lawyer for this case !!

When you say minimal initiative - what do you mean. This type of thing takes time. You have to remember that your friend has to bill a certain number of hours a month/year for the firm she works for, and that can be an incredible goal to meet. Be patient. Just from reading serveral comments posted about NCO, I know of your affiliation with them that is why I have been quite careful of what I say. I sincerely appreciate the contact name and info. At this point, I am not going to call another soul until I consult the appropriate legal authority. Bank of America has continuously been giving me the runaround of this identity theft issue. NCO has not contacted me since I demanded the statement and are not supposed to until 30 days after the statement has been sent and I have had the chance to review it. So, they will at least leave me alone for the next month. I am currently searching for legal help with the BOA situation. You said you knew of some good attorneys in this region for this case. Madeye, I know that you're really busy giving advice to so many people, but I have a question I think you can answer. I friend of mine had her SUV repossed last year. She is has never heard anything from Ford Credit concering the repossesion. Now she has received a letter from a collection agency telling her that she's owes almost $9000 it. She called them, and the lady she spoke with said the full amount needed to be paid within the next few days. And get this, she told her it would be cheaper than paying lawyers when Ford takes her to court. She's absolutley hysterical over this and is thinking about dipping in to her retirement to pa more >>

If it was repossessed that means it may have been sold at auction. The 9000 may be the balance she owed on the defaulted loan, minus the amount the SUV sold for at auction. I would get documentation on all this, and put the numbers together. She may verywell owe this amount. However - she may not. If it turns out things aren't adding up, then she needs to get a lawyer to make sure she's not taken advantage of.

I've read most of the reviews and comments on NCO, and I can't believe the crap that they try to pull over on people. What's so sad, is that most people have minimal knowledge of basic laws and actually beleive some of NCO's threats. You, however, raise everyone's awareness. I just wished that my niece's college student friend has read your advice before she decided to commit suicide over credit debt.

What actions can I take if NCO Financial submitted something to my credit report after they promised they would not? I paid them as soon as I get a letter from them collecting for a bill from a hospital in Sherman, Tx. that was in error due to the hosital's incorrect billing to BCBS.
I paid NCO with a credit card over the phone, they promised it would not go on my credit report, as I indicated very strongly that it better not, as I am getting ready to buy my first home.
The home I wanted is being bought from under me, due to NCO posting the PAID comment to my credit report.

She's not too impressed with her lawyer because he told her that the judge will look at her Teacher Retirement as income. The lawyer didn't realize that TR takes the place of SS. He's a good guy...very very knowledgable. I've not spoken to him on the phone yet, but he's a great source of info, and instruction. Better than me in many respects. (Man, is that hard to admit).
Anyway - get his free course first. I haven't paid for his full course, nor do I know for a fact how effective it is (Excellent, I'm sure); but I can pretty much get behind just about everything he says. He's on the consumers' side, through and through.

Just found this web site after being harrassed and then turned over to a law firm to resolve my debt with NCO. I have been making regular payments and know that I am basically paying interest fees among whatever other fees they decided to tack on. I would like to pay off my debt and wanted to know if there is anything I can to to have them cut out some of these insane fees. Any advice?

You can dispute the amount, or ask them to account for it...but that's usually done before you start paying anything. If you agree to terms of payment, that can be viewed as you confirming the amount of the debt as valid. Legally, you can dispute the amount any time, and some inquiries to them in good faith might yeild some favorable results. However, I would defer to CreditWrench if you want to know how to bend them over backwards for you. He's got phenominal techniques and this aspect (that of validation of amounts owed) is one of his forte's.

Hi mad eye, I've been getting emails kicked back to me from creditwrench. The problem is that I haven't emailed him for two months, so it's not me sending them. I read through them more carefully and its says from helo=NCO and then a bunch of letters and digits.org. Either someone got my email address from here or creditwrench. I really don't know that much about viruses, so what should I do about it?

Just erase them when you get them. Unless you open the attachment, you aren't really in danger of screwing up your system. I don't know if it's a virus doing it all, or a virus being sent by a person, or whatever; Just don't open the attachements...or the email at all.

I did open a couple for the failure delivery ones though because I thought It was a message I sent to my husband's cell phone overseas. Does the helo=NCO mean anything? I got 4 day on my bulk mail and erased them all w/o opening them.

Mad Eye: I was referred to you by debtorbasher. I have a $16,000 card with Citicard that went to NCO. I was called and spoke with two goons who were surreal. I attempted to set up a payment plan, but they were only interested in giving me a hard time. I went to the NCO website, obtained the home office address, and overnighted a money order for $350 with my account info., and told them I would send in at least $250 per month until the debt was paid off. Given what I have read in this website, I didn't want to send a check or set up autopayment. I just don't want a judgment filed against me. Can they do that if I keep up with the payme more >>

omh - have you talked to the original creditor on this. Perhaps they are willing to take back the balance from NCO and work out a payment plan that you can manage. NCO isn't known for keeping their promises. They may accept your payments for a while, and then turn around and sue you for the balance anyway. You need to also find out if NCO owns the account now, or was just hired to collect on it.

Madeye...I'm seeking your advice...when a person comes into some money and wants to pay on their debts...would it be better to pay off a smaller debt, or would it be best to apply it to a larger balance which wouldn't pay it off, but will bring the balance lower? The reason I ask is because the smaller balanced account has low monthly payments, but I always pay more than the minimum...and if I paid on a larger balance, I'd still have a balance but the monthly payment will be less than what it is now. Or should I go strictly by the APR?

Pay off the high APR's first. I know it's tempting to want to pay off a bunch of little debts just to have that many less envelopes to stuff per month, but you'll save money in the long run if you knock down the balances on the accounts with higher APRs as soon as possible. You and I both know that's where these companies make most of their money. That's where most disputes over debt occur...the inflated amount that is reported as due after the APR has been liberally factored into the equation. I'd pay off all your bills for you, but then I run the risk of never being able to represent you in court if you ever have to sue a CA, like NCO.

A debt collector has my cell phone number and is trying to collect a debt that they admit is not mine. They call me everyday. They want me to either pay the debt or get the other person to pay the debt. I just want them to stop calling me.

Once you tell them not to call your cellphone, they have to honor that request...because people pay for their minutes used, this would be covered under the FDCPA "Unfair Practices",which state that a debt collector can not "cause charges to be made to any person for communications by concealment of the true purposes of the communication. Such charges incldue, but are not limited to, collect telephone calls and telegram fees". Being that a person is charged for airtime on their celluar phones, it is safe to say that continuing to call a cellphone once the collector is aware it is a cellphone...it would be an FDCPA violation.

You can make a quick $1000 if you take your cell phone bill to a consumer lawyer.(Or you could write them a demand with a copy of the cell phone bill yourself citing the parts of the FDCPA they violated) Is it your only phone, or do you have a land line as well? It won't make much of a difference if you told them not to call...but it's easier to demand your statutory damages (in exchange for NOT suing)when their violations are as obviously blatant as they seem to be in your case.

The only problem with providing a cell phone bill now, Maddy, is when people buy pre-paid cards to use...then how would they prove anything without a bill? All you would have is maybe phone numbers from incoming calls on the phone...what could they do then?

Doesn't matter. Prepaid or not, there's a record of incoming calls, and incoming calls do incur a charge in most cases (Depends on the card/service provider). As long as that collector calls knowing it would run-down the consumer's prepaid minutes, then the section of the FDCPA cited above applies. It'll probably change as more and more cases are decided one way or the other; with many people getting rid of their land lines all together, there's going to have to be some change in the interpretation of the section as it applies here.

Advocate Mad Eye or collector Debtor I have a question. A little exposition: My x-wife was a prolific doctor shopper and covered under my health insurance. I was aware of the dr shopping but at that point didn’t care. The bills always came in her name and I stayed out of it. About a year after I got divorced she filed bankruptcy. Shortly after that I received a call from a collector for a couple of her unpaid medical bills. They told me since she filed bankruptcy and IAW with Oklahoma statute I was now responsible. I know that when my Mother added me as an authorized user on one of her credit cards (so I can do some shopping for her), it appeared on my credit report...thankfully, my Mother always pays her bills and has A1 credit, as I do also...but I was surprised to find her credit card info on my report.
